What Is Foreclosure?

Foreclosure is the legal process in which a piece of property is sold in order to repay debts that are owed by a property owner. Under Texas law, there are three different methods of foreclosure: judicial, non-judicial, and expedited.

Judicial Foreclosure

In a judicial foreclosure, the loan lender — or lienholder — must first file a civil lawsuit against the homeowner and obtain a court judgment before they can foreclose the property in question.

Non-Judicial Foreclosure

Also known as “power of sale” foreclosure, a non-judicial foreclosure is what its name suggests: a foreclosure that doesn’t require an initial civil lawsuit against the homeowner. Rather, the lienholder only needs a deed of trust with a “power of sale” clause in order to sell the property.

Expedited Foreclosure

When a lienholder is pursuing an expedited foreclosure, they must notify you within 10 days of the date they file. Once you receive the notice of foreclosure, you will have 38 days to respond.
